These Terms of Service ("Terms") govern your use of Spadesinator, the online Spades card game available at https://spadesinator.com (the "Service"). The Service is operated by Spadesinator ("we", "us", "our"), based in Oregon, United States. By using the Service you agree to these Terms. If you do not agree, do not use the Service.
The short version: the game is free to play. An optional paid subscription adds AI art features. Play fair, keep the art you generate within the content standards below, and cancel your subscription any time. Questions? Email spadesinator@gmail.com.
You must be at least 16 years old to use the Service. By using the Service you represent that you meet this requirement. Some features require a signed-in account (Google sign-in); you are responsible for activity that happens under your account and for keeping access to it secure.
Spadesinator is a free online Spades game playable against other people and against computer opponents, including AI opponents with conversational personalities. Nothing in these Terms takes away the free game: an account and a subscription are optional, and guest play remains available.
Spadesinator Plus is a paid monthly subscription. It renews automatically each month, and your payment method is charged the subscription price at the start of each billing period, until you cancel. The current price is shown at checkout and on the plans page before you subscribe.
You can cancel any time from the Account screen using Manage billing, which opens a self-service billing portal. Cancelling stops the next renewal; your subscription benefits continue until the end of the period you have already paid for. No further charges are made after cancellation takes effect.
Payments are processed by Stripe. Your purchase may be sold through Stripe as the merchant of record, in which case Stripe is responsible for tax collection and your receipt identifies Stripe accordingly. We never see or store your full card details. Stripe's own terms and privacy policy apply to the payment itself.
If we change the subscription price, we will notify you at least 30 days before the new price takes effect, by email or by a prominent notice in the Service. The new price applies from your first renewal after the notice period. If you do not agree with a price change, cancel before that renewal and you will not be charged the new price.
Because the subscription is monthly and can be cancelled at any time, payments already made are generally not refunded, and partial months are not prorated, except where a refund is required by applicable law or where we choose to issue one. If you believe you were charged in error, contact us at spadesinator@gmail.com and we will work it out with you.
Signed-in players receive a one-time grant of a small number of free art generations after finishing their first game. The trial requires no payment method, never converts into a paid subscription automatically, and artwork you create with trial credits remains yours to use in the Service even if you never subscribe.
Subscribers and trial users can generate custom card backs and table emblems from text prompts. Generated artwork is attached to your account and, when you select it, is visible to the other players at your table. Because other people, potentially including minors, see this art, every prompt and image passes through automated content review, and other players can report artwork they believe breaks the standards below.
Artwork and prompts must not contain any of the following:
Decorative text, fictional characters, animals, stylized or historical figures, and dark or spooky themes are all fine. We may reject a prompt or image, remove artwork that violates these standards, and notify you by email when we do. Repeated or serious violations may lead to loss of generation features or account termination.
We do not claim ownership of artwork you generate. To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to store, process, reproduce, and display your generated artwork within the Service, including showing it to other players at your table and creating resized copies. This license ends when the artwork is deleted, except for copies we must keep for legal, safety, or backup purposes.
Be aware that artwork produced by an AI model may not be protectable by copyright, and similar prompts can produce similar images for other users. You are responsible for the prompts you write, including making sure they do not misuse someone else's name, likeness, or rights.
You can delete your generated artwork at any time from the Account screen. Deleted artwork stops being available immediately for new games; game tables that were already using it may continue to show it for up to 24 hours.
You agree not to:
AI opponents, including their table chat and any memory of past games they appear to have, are fictional personas generated by machine learning models. Their statements may be inaccurate and are provided for entertainment only. Do not rely on anything an AI player says.
Optional features let you supply your own API key from a third-party AI provider. If you do, all usage of that key is billed directly by that provider to you, at your own risk and cost. We accept no responsibility for any charges you incur through your own key, and your use of the provider is governed by the provider's own terms. See the Privacy Policy for how keys are handled.
Game results can appear on public leaderboards under your display name. You can opt out of leaderboard display in your account settings at any time.
You may stop using the Service at any time, and you may request deletion of your account and its data by emailing spadesinator@gmail.com, as described in the Privacy Policy. We may suspend or terminate your access, or remove content, if you violate these Terms, if required by law, or if we discontinue the Service. If we terminate a paid subscription without cause, we will refund the unused portion of the current billing period. Sections of these Terms that by their nature should survive termination (including licenses needed to wind down, disclaimers, and limitation of liability) survive it.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted availability. Online games have outages, updates, and occasional bugs; we do not promise the Service will be error-free.
To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of ten US dollars or the amounts you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; nothing in these Terms limits rights you have as a consumer that cannot be waived.
These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Oregon, and you consent to their jurisdiction, except where the law of your place of residence gives you a non-waivable right to another venue.
We may update these Terms from time to time. For material changes we will give notice by email or a prominent notice in the Service before the change takes effect, and update the "Last updated" date above. Continuing to use the Service after a change takes effect means you accept the updated Terms.
